Enquiries, Quotations and Order Acceptance

Prices, Currency, Taxes and Charges

Commercial amounts must be confirmed for each order.

Unless otherwise stated in the relevant quotation, proforma invoice or invoice, the applicable currency, pricing basis and delivery terms shall be those specified in that document.

  • Prices may be quoted in MYR, USD or another agreed currency.
  • Prices may exclude freight, insurance, inspection charges, destination duties, import taxes, customs fees, banking charges and other third-party costs unless expressly stated otherwise.
  • Applicable taxes and government charges will be applied according to law and transaction structure.

Payment Terms

Payment is required according to the agreed commercial arrangement.

Payment terms are subject to the relevant quotation, invoice, proforma invoice, purchase order acceptance or other written commercial documentation.

  • Unless otherwise agreed in writing, payment must be made before shipment release.
  • We may require full advance payment, a deposit, milestone payment, or another arrangement agreed between the parties.
  • Bank transfer charges, exchange losses and intermediary bank fees are the responsibility of the payer unless otherwise agreed.
  • Late payment may result in withholding shipment, suspending service or cancelling future orders.

Shipping, Delivery and Cold Chain

Delivery timing depends on logistics and destination requirements.

Delivery timelines are estimates unless specifically confirmed in writing. Shipment timing may be affected by harvest conditions, cold storage scheduling, vessel or airline capacity, customs clearance, inspections, weather, port congestion, force majeure events or other factors beyond our reasonable control.

We aim to handle seafood products under appropriate cold chain practices suitable to the product and shipment method. However, delivery performance may also depend on third-party carriers, customs agencies, import handling and the buyer’s own receiving arrangements.

  • Risk and responsibility may pass according to the agreed shipment terms, delivery terms or other written arrangement.
  • The customer must ensure that the receiving address, contact person, import permissions and receiving facilities are correct and ready.
  • Any stated shipping date is an estimate and not a guarantee unless expressly agreed.

Inspection, Receipt and Claims

Claims should be made promptly with proper evidence.

The customer is responsible for inspecting products promptly upon receipt. Any issue relating to damage, shortage, incorrect items, packaging defects, temperature concerns or quality concerns should be reported to us as soon as reasonably possible, and in any event within 24 hours of receipt, unless a different timeframe is stated in the relevant sales document.

Claims should include adequate supporting evidence, which may include:

  • clear photographs or video of the goods, packaging and labels;
  • delivery or receiving records;
  • temperature or storage records, where relevant;
  • batch, lot or shipment identification details;
  • a description of the issue and quantity affected.

Failure to inspect promptly, maintain suitable storage, or submit sufficient evidence may affect our ability to assess or accept a claim.

Returns, Refunds and Replacements

Perishable goods usually cannot be returned.

Due to the perishable nature of seafood products, returns are generally not accepted unless otherwise agreed in writing or where required by applicable law.

If a verified quality issue or shipment discrepancy is accepted by us after review, we may, at our discretion and subject to the specific circumstances:

  • issue a partial or full credit;
  • offer a replacement in a future shipment;
  • agree another reasonable commercial remedy.

Remedies are assessed case by case, taking into account product condition, timing, evidence, handling after delivery and the agreed commercial terms.

Export Compliance and International Trade Requirements

Cross-border trade must follow applicable laws and destination-market requirements.

Because our business may involve cross-border supply and export activity, customers acknowledge that shipments may be subject to applicable laws, regulations and regulatory checks relating to import, export, food safety, sanitation, product labelling, customs, documentary requirements, trade restrictions and destination-country market access.

  • Buyers are responsible for ensuring that products ordered are permitted for import into their destination country or region.
  • Any import licence, permit, registration, local approval or destination-country compliance requirement remains the buyer’s responsibility unless expressly agreed otherwise.
